The use of IA Group Portal (IA Portal) is subject to these User Terms and IA’s Privacy Policy. Please read the User Terms and the Privacy Policy carefully. By accessing and using IA Portal you agree to be bound by these User Terms and IA’s Privacy Policy. These User Terms and IA’s Privacy Policy may be amended by us from time to time. These Terms of Use must be read in conjunction with any other applicable terms and warnings governing the use of this Portal.
Authorized User(s) means a person(s) authorized by IA to access the IA Portal.
Client(s) means IA's client(s) which Authorized Users access the IA Portal.
Content means any text, software, database, format, graphic or written work and all materials developed by, or on behalf of IA which are or form part of IA Portal.
File means any file entrusted by the Client to IA.
IA Portal is an internet web-resource which allows an online access to information regarding the status of investigation and collection of the files entrusted to IA Group (“IA”) by its clients. IA Portal may be found and accessed at https://portal.iagroup.com
Our information means any information placed on or distributed through IA Portal.
Password means a set of characters that, together with the username, grants the Authorized User access to IA Portal.
Personal Data means any data through which natural persons can be individually identified.
Username means a sequence of characters that identifies the Authorized User.
We or us means IA.
You or your means the Authorized User.
"Your Information" means any information which the Authorized User posts or provides IA to post on IA Portal.
Other definitions can be found in IA Portal’s Users Guide which will be provided to the Authorized User by e-mail.
3.1 Access to IA Portal is restricted to Authorized Users through a username and login process. After receiving an invitation to access IA Portal you are requested to set a secure password to be used in combination with your username. If you have been given access to IA Portal by mistake, please leave IA Portal’s website and contact us by email at portal@iagroup.com as soon as possible.
3.2 IA provides each authorized Client with access to IA Portal for the files of that Client only.
3.3 The access to IA Portal is solely for internal business purposes of the Client.
3.4 The Client shall provide IA a list of the Authorized Users. Any change as to the Authorized Users shall be notified to IA, within 7 days, in writing via e-mail sent at portal@iagroup.com. The Client is solely responsible for the accuracy of the Authorized Users’ list.
3.5 IA has sole discretion to decide which files and what information therein can be viewed on IA Portal.
3.6 The information contained on IA Portal is provided by us in good faith on an "as is" basis and for the Client’s internal purposes. IA’s does not make any representation or warranty that the information contained on IA Portal is reliable, accurate or complete or that your access to that information will be uninterrupted, timely or secure. We do not accept responsibility for loss suffered as a result of reliance by you upon the accuracy or currency of information contained on IA Portal.
3.7 IA retains control over all data shown on the IA Portal and reserves the right to move data within the IA Portal and to delete data from the IA Portal at its discretion.
3.8 IA can revoke access to the IA Portal of any Authorized User with immediate effect and without prior notice.
3.9 If you breach these User Terms, your right to access IA Portal will be revoked and cease immediately. Upon our request at any time, you must, at our option, return or destroy any copies of Our Information that you have made.
4.1 Certain fields on IA Portal may be blank or not always up-to-date where (i) there are information release delays at various registers and databases in various countries, (ii) data or information is not relevant to a specific file, etc.
4.2 While efforts are made to provide accurate and updated information through IA Portal, it is possible that data and information at IA Portal may contain errors or omissions and may not be always current.
5.1 IA Portal is based on the third-party software solution.
5.2 IA intends to make IA Portal accessible every day, 24-hours. However, IA does not commit or guarantee that the IA Portal will be available 24-hour or that servicing the IA Portal will be available 24-hours.
5.3 IA Portal may, at times, be unavailable due to regularly scheduled maintenance, service upgrades or other mechanical or electronic failures. IA is not responsible for any loss or damages caused during the period when IA Portal was not available.
5.4 IA intends to make IA Portal accessible every day, 24-hours. However, IA does not commit or guarantee that the IA Portal will be available 24-hour or that servicing the IA Portal will be available 24-hours.
6.1 Any Information placed on or hosted by IA Portal is confidential and may be privileged. You must not disclose the Information to any person who is not authorized.
6.2 Confidentiality of the username, password and account itself are the responsibility of the Authorized User. Any activities that occur under the Authorized Users’ accounts are their responsibility.
6.3 IA must be notified immediately of any unauthorized use of accounts or any other breach of security. An email must be promptly sent at portal@iagroup.com.
6.4 The use of an Authorized User's username and password by any other than the Authorized User is expressly prohibited.
7.1 You are solely responsible for the Information you post or provide to us to post on IA Portal. You must ensure that Your Information is legal, accurate and truthful, comply with all laws and regulations, do not infringe the intellectual property rights of IA or any third party, and is not unreliable or misleading.
8.1 In view of applicable privacy legislation, we strongly advise against including any personal data in the open text fields available in IA Portal. For further information please see our Privacy Policy.
8.2 If Your Information include any Personal Data, you will ensure that such data is provided in accordance with the applicable data protection legislation.
8.3 We undertake to comply with the terms of our privacy policy which is accessible at https://www.iagroup.com/legal/privacy-policy.
When you choose to use our IA Portal, we will place certain cookies on your device (e.g. your computer, smartphone or tablet) in order to ensure that the IA Portal works properly. Cookies are small data files that are stored by your browser on your device read out when you use the IA Portal. IA uses the following functional cookies, also known as necessary cookies:

10.1 IA is the owner of IA Portal’ s intellectual property rights, Our Information and the Content. You do not acquire any right, title or interest in any of those rights.
10.2 Except to the extent permitted by IA in relation to a particular file, and as to the extent as permitted by law, you must not copy, modify, download, print, distribute or decompile the Information or the Software without our prior written consent.
10.3 If third party software is required for you to access or use IA Portal, you must obtain a license of such software at you own expense.
11.1 IA and its team devote its best efforts to verify the accuracy of the information received from debtors and third parties. However, IA is not liable for the accuracy of the information available on IA Portal.
11.2 IA’s liability is limited to the terms agreed between IA and the Client on their corresponding contract.
11.3 We accept no liability for any failure to comply with these Terms of Use where such failure is due to circumstance beyond our reasonable control. If we waive any rights available to us under these Terms of Use on one occasion, this does not mean that those rights will automatically be waived on any other occasion. If any of these Terms of Use are held to be invalid, unenforceable or illegal for any reason, the remaining Terms of Use shall nevertheless continue in full force.
Dutch law shall govern the legal relationship of these User Terms. Any dispute between IA and a Client shall be resolved in the first instance exclusively by the District Court (rechtbank) of Amsterdam, the Netherlands.
